1. Agreement to Terms
By accessing or using any service provided by Dreamwell Technologies ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
Dreamwell Technologies provides AI-powered business automation products and services including but not limited to:
- Billing and invoicing applications
- WhatsApp AI chatbots
- Inventory and wholesale/retail management
- Apartment maintenance management
- Custom website development
- Logistics and fleet management
- Finance and accounting applications
- Custom AI agent development and consulting
We reserve the right to modify, update, or discontinue any service with reasonable notice to existing customers.
3. Payment Terms
Payment is required before service activation. Our pricing includes:
- Setup Fee: A one-time fee charged at the time of purchase to cover product configuration, customization, and onboarding.
- Monthly Subscription: Recurring monthly charges for ongoing product access, hosting, maintenance, and support. Billed in advance.
All prices are in Indian Rupees (INR) and include applicable taxes. Payments are processed securely through Stripe. We reserve the right to change pricing with 30 days advance notice.
4. Intellectual Property
All intellectual property, including software, designs, logos, and content provided by Dreamwell Technologies, remains the property of Dreamwell Technologies. You are granted a non-exclusive, non-transferable license to use our products for the duration of your subscription.
Any data you input into our products (invoices, customer records, inventory data, etc.) remains your property. We do not claim ownership of your business data.
5. User Responsibilities
- Provide accurate and complete information during registration.
- Maintain the confidentiality of your account credentials and accept responsibility for all activities under your account.
- Use our services only for lawful business purposes in compliance with applicable Indian laws.
- Not attempt to reverse engineer, decompile, or modify our software.
- Notify us immediately of any unauthorized use of your account.
6. Service Availability
We strive to maintain 99.5% uptime for all products. Scheduled maintenance will be communicated at least 48 hours in advance. We are not liable for downtime caused by factors beyond our control, including internet outages, natural disasters, or third-party service failures.
7. Limitation of Liability
To the maximum extent permitted by law, Dreamwell Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim in the 12 months preceding the claim.
8. Termination
Either party may terminate this agreement:
- By you: With 30 days written notice via WhatsApp or email. See our Cancellation & Refund Policy for details.
- By us: With 30 days notice for any reason, or immediately if you breach these terms.
Upon termination, your access to the service will end at the close of the current billing period plus any applicable notice period. Your data will be retained for 30 days and then permanently deleted.
9. Governing Law
These terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Coimbatore, Tamil Nadu, India.
10. Dispute Resolution
In the event of any dispute arising from these terms, both parties agree to first attempt to resolve the matter through good-faith negotiation. If negotiation fails, either party may initiate arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English in Coimbatore, Tamil Nadu.
11. Changes to Terms
We may update these Terms of Service from time to time. We will notify existing customers of material changes via email or WhatsApp at least 30 days before they take effect. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
